21/02/04 A Case Of Human Rights - Please read this story?
Dear Mr Pilling;
Thank you for your support and your offer of help; I am very grateful to know people care its more than can be said for the: East Riding Council of Yorkshire.
I am a 45 years old man and I am very seriously ill with a magnitude of disabilities.
The story so far!
The Council of the East Riding of Yorkshire have been providing me a joint care package funded by the Council and Independent Living Fund in the case of the council its been 5 years; in the case of the I .L. F its been 4 years; the council have been providing me care for 7 years in total. A couple of officers in the East Riding have decided to victimise me and as a result they wanted me to go through assessments which I have done. Despite my Doctor; the Hospital consultant and the Occupational Therapist Reports
the council refuse to accept there findings, despite the independent living fund. Social Worker who says; I need more care the Local authority refuse to accept his findings that I need more care; not less! Despite an Independent Social Work report form Middlesborough stating; I need more care
the council refuse to accept this as well?
What the council of the East Riding did was to convene secret meetings without any representations from my doctors and the council; sent there own social worker who is supposed to be independent to see me with a councillor who acted as my friend but failed to tell the council that when she and the councillor attempted to get me on my bed I fell off; Oh Yes! I fell off but nothing was mentioned about this. She covered it up then the council got some staff from the Yorkshire Wolds and Coast Primary Care Trust to be involved; they all had there say but None; ever saw me yet between them and 2 social workers of the council they decided to CUT!! Cut!! my care I need.
Also as I employ my dedicated staff who have looked after me for 5 years and 3 years irrespectively; I am told my care is going to be cut in 3 weeks despite me having to give four weeks notice to my staff; this should take place on the 1st March 2004.
I have been to court got an injunction its cost over £30.000 from our sides in legal funding how much from the councils side? Taxpayer’s monies being wasted again then to go to a judicial review another £10.000 apiece at least!!!! The Judge gave me an injunction; part victory however this council will not stop its action and accept; I need care! They only want to give me 21 hours a week which will mean I lose all of my I .L. F care and therefore my staff!
This council is determined to get me!! Because; I am the main man in this county who fights for disabled people if my care goes this will be a start to other losing there care I am seen as a test case but some judge has sense to see from all the medical reports I need care; constantly; not part-time!
My Doctors integrity have been brought into question the hospital doctors integrity have been brought into question the occupational therapist have been brought into question are all our staff from Bridlington Hospital; Scarborough Hospital all useless? It beggars belief the questions to be asked. How can the council spend £135.000 on my home provide me with care for 7 years then turn around and say; I do not need care; it despite all the medical evidence that as been supplied no other person who receives care has to go through this process.
My doctor offered the council a chance to get me to see independent Doctors from outside the area not connected with the hospital or his practice; the council refused to accept this but carried on with secret meetings to dissemble my care. Now they want to give me the run-around; yet again.
The council knew with no staff my dog would have to be put down; I would lose my home; go bankrupt and have nothing at all in the world; they tried to destroy me; but I am hanging in and fighting.
Anyone of sound mind who is reasonable would accept medical evidence but oh no not this council we the disabled don’t need care we don’t need protection we do not need support we need to suffer not whilst I live; I will fight to protect other disabled people.

My doctors have confirmed; I am getting worse and I need more care but the council say no; the council expects me to go to bed wearing nappies so it can save monies?
Care in the community is about being able to live ones life not in the eyes of this council. This so called council is not a caring council it uses bully boy tactics to abuse disabled people like me well I will not be abused and I will stand my ground and I will fight for justice even if I have to die in the process.
By the way Mr Graham Baverstock is wheelchair-bound and has constant ill-health; most brought on by the council who do not wish to understand this mans plight; Graham also suffers from: Arthritis; Osteoporosis; obstructive Pulmonary Disease and cannot get in or out of bed without help. Disabled Charities welcomed today’s news from the High Court Judge. Mr Baverstock at times may be loud; swear and shout; people should understand this mans frustration at been so disabled and un-well; it would drive most to the extreme!
